These Terms of Service ("Terms") govern access to and use of TrueLevel's platform, websites, and services (the "Service"). By creating an account or using the Service, you agree to these Terms.
You must provide accurate information and keep your credentials secure. You are responsible for activity under your account. You must be at least 18 and authorized to bind the company you represent.
Paid plans renew automatically on the cycle you selected (monthly or annual). You may cancel at any time; your plan continues until the end of the paid period. Except as provided by the money-back guarantee in Section 3, fees are non-refundable except where required by law. We may change prices on renewal with 30 days' notice. Any promotional or negotiated rate is locked as described at time of signup.
New customers may request a full refund of their first subscription payment within 30 days of that payment by emailing sales@truelevel.app. We refund to the original payment method and cancel the subscription at the same time; access ends on refund. The guarantee covers a customer's first paid subscription only and may be used once per customer. It does not cover renewals, additional seats or sites added later, or amounts already refunded.
You agree not to:
You own the data you put into the Service ("Customer Data"). You grant us a license to use Customer Data solely to operate and improve the Service for you. We will not sell Customer Data or use it to train third-party AI models.
We target high availability but do not guarantee uninterrupted service. Scheduled maintenance, third-party outages, and force majeure events may cause downtime. For enterprise plans, SLA terms apply as specified in the order form.
The Service, including software, UI, and content we provide, is owned by TrueLevel and protected by IP laws. No rights are granted except as expressly stated.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be error-free or meet all your requirements.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUELEVEL'S AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.
We may suspend or terminate your access for material breach. You may cancel at any time. On termination, your right to access the Service ends; we retain data per the Privacy Policy.
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Delaware.
We may update these Terms. Material changes will be notified at least 30 days in advance. Continued use after the effective date constitutes acceptance.
